Divorce called mutual termination of a marriage between husband & wife. It is an act that finished their responsibilities between the legally married couple.

As per Indian law, there are diverse grounds of divorce given under Section-13 of the Hindu wedding Act, 1955. Section-13(b) of the act states divorce by Mutual break up which means both husband & wife are not willing to stay together and they mutually want to break up the marriage.

The divorce can be decided if both husband & wife have been living independently for one year or more living in the same house but not living as a pair.

The only key which needs to be fulfilled is that they mutually agreed to cancel their wedding and there is no scope of future adjustment.

Both parties file the divorce appeal in the court for the termination of marriage. The petition must be filed in the Indian family court of the place where the wedding was held or where both parties’ husband & wife lived together.

The 1st stage, the divorce case lawyer makes confirmation, a petition signed by both the husband & wife as divorce by joint consent is always a mutual petition and they must also state all the practical statements for taking divorce.

After filling the divorce petition family court gives a period of 6 months to both parties to reconsider the issues. This time limit given by the family court is called a cooling-off timeline. Moreover, the party can leave the petition within 6 months from the date of arrangement if it states that they don’t want a divorce through joint consent.

The petition can also be quiet when either of the party is ready to modify and change the wedding for a better future.

Now the 2nd action in which after the finish time period of 6 months given by the family court another appeal is filed by the divorce lawyer with the same process followed in 1st petition. After the proceedings and other formalities, the family court passes an order of decree of divorce as the final judgment.
